Virginia looks back five years, not three

Jurisdiction matters more than most people realize, and Virginia is the outlier in our region. If you are moving across the river, this is worth knowing.

What is different in Virginia?

The timeframes. In the District and Maryland, a claim surcharge typically runs for three years. In Virginia, the experience period is five years for surcharge and rating purposes, and carriers look back seven years when assessing eligibility.

That is a materially longer shadow. A claim filed in Arlington or McLean in 2024 is still affecting your rating in 2029 and can still be considered for eligibility into 2031.

Why does that change the advice?

Because the arithmetic of filing changes with it. In DC, a marginal claim buys you three years of surcharge. In Virginia it buys five. The threshold below which filing is a poor decision therefore sits higher, and I am correspondingly more cautious advising Virginia clients on small losses.

It also affects timing when a household has had claims. If a client in Maryland was declined for activity, we can often re-approach the market after three years. In Virginia that wait is longer, and I would rather set that expectation honestly at the outset than have someone hoping for a solution that is not available yet.

Does this apply to auto as well as home?

Yes, and it is the same principle. A collision claim where you were at fault carries the surcharge for the applicable period, and a second at-fault collision will see most carriers non-renew regardless of which side of the river you are on.

What I recommend

  1. Know which rules apply to you. If you live in Virginia, assume five years, not three.
  2. Set your deductibles with that longer window in mind — a higher deductible is more valuable in Virginia, not less.
  3. If you are relocating within the DMV, ask how your existing claims record will be assessed under the new state's conventions.
  4. If you have been declined for claim activity, ask me when the clock actually runs out.

The short version

Virginia runs a five-year experience period for surcharge and rating, and carriers look back seven years for eligibility. That longer shadow raises the threshold below which filing a claim is a poor decision, and it lengthens the wait if you have already been declined.

As always, if you have any questions, please don't hesitate to reach out.
